Membership terms and Conditions
CONSTITUTION
" The Centre" is the Leisure Centre operated by Nexus Community - please refer to www.nexuscommunity.org for a full list of leisure centres.
" The proprietor" being Greenwich Leisure Limited, registered office: Middlegate House, The Royal Arsenal, London SE18 6SX"

" The member" is the applicant as described overleaf
ACCEPTANCE AS A MEMBER
1. The Proprietor has an absolute discretion upon whether to accept the application for membership of the Club. Upon acceptance, the Member will be issued with a Membership Card personal to him and shall be entitled to all of the rights and privileges exercisable by the class of Members for which his application for membership has been accepted.
2. ACCEPTANCE BY PROPRIETOR OF AN APPLICATION FOR MEMBERSHIP OF THE SCHEME SHALL CONSTITUTE A BINDING CONTRACT BETWEEN THE PROPRIETOR THE MEMBER UPON THESE TERMS AND CONDITIONS OF MEMBERSHIP AND THE RULES OF THE CENTRES.
LIMITATION OF LIABILITY
3. In consideration of the Proprietor accepting his application for membership of the Club and for him becoming and remaining a member of the Club the Member agrees that:
4. Neither the Proprietor nor the employees or agents of the Proprietor shall be liable for
any loss, damage or theft of personal property belonging to the Member whatsoever and
howsoever occurring on the Proprietor’s premises except to the extent that such loss or
damage arises from any negligent act or omission of the Proprietor or any agent or employee of the Proprietor.
5. Neither the Proprietor nor the employees or agents of the Proprietor shall be responsible for any death or injury occurring upon the Proprietor’s premises as a result of the use of facilities and/or equipment provided by the Proprietor, except to the extent that such death or personal injury arises from any negligent act or omission of the Proprietor or any agent or employee of the Proprietor.
PHYSICAL CONDITION OF MEMBERS
6. A Member must ensure that he signs initially on joining stating that he is physically capable of undergoing the normal routine of exercise provided by his programme. It is the responsibility of the Member to update his medical record and/or address should this information change. If in doubt the Member should consult his Doctor before embarking on a routine of exercise as all exercises, treatments and use of facilities shall be undertaken at the Member’s own risk without any recourse on the Proprietor or any agent or employee of the Proprietor.
ASSIGNMENT
7. Members cannot sell, assign or transfer their membership.
MEMBERSHIP
8. Joint Membership where applicable shall be available to spouses and people residing at the same address. Members shall be subject to the rules governing Members and each Member is jointly and severally liable for the full contract value and any costs incurred as a result of obtaining payment. The Proprietor may request reasonable evidence of joint residence etc. prior to acceptance as members.
9. Club membership is valid for use of the assigned facilities at the designated sites only.
10. Club membership includes membership of the relevant discount “pay as you go” membership scheme and members are entitled to the benefits offered by this scheme. The details of this scheme can be obtained from the relevant sites.
11. Corporate Member rates are dependent on the member remaining employed by the company in the scheme and the number of members from each company in the scheme and are liable to change accordingly. The Proprietor shall inform the organiser of the corporate scheme prior to any such increases and where a members account is being debited on a monthly basis the Proprietor shall give the member not less than 30 days notice prior to any such increases.
MEMBERSHIP SUBSCRIPTION
12. Customers joining on a monthly prepaid membership option must pay by direct debit. Failure to make any due payment will result in the membership being suspended. Access will be denied until outstanding payment has been made. Any further outstanding account arrears will be payable before reinstatement of any membership scheme run by the Proprietor. The Proprietor retains the right to recover all outstanding balances.
13. Monthly direct debits are a full binding contract between the Proprietor and (the Member) and will automatically continue until the Proprietor is notified otherwise in writing.
14. Adult members may at any time apply to freeze his membership. This should be requested in writing with 30 days notice to the Club Manager. The proprietor retains absolute discretion but will consider applications based on e.g. medical necessity, pregnancy. Prepaid memberships can only be frozen based on medical necessity and where supported by a medical certificate. Direct debit memberships will only be considered for minimum of 1 full month to a maximum of 6 months in each case, each member can apply a maximum of 2 times per annum.
15. If a member wishes to amend his Direct Debit details i.e. the nominated account or type of membership, new details must be provided with 30 days notice to the Membership Department.
16. Membership subscription shall be payable by each Member irrespective of the actual usage of the Club or change in personal circumstances and shall be debited to the Member’s bank account or paid in advance as specified.
17. The Proprietor may increase membership subscriptions at any time. The Proprietor shall give the Member not less than 14 days notice prior to any such increases.
18. All applications made under a direct debit membership will be subject to a £10
administration fee; this must be paid upon joining. The administration fee will also be applied to membership which are cancelled and reinstated either by the customer directly or as an advice from BACS. The administration fee is subject to change at anytime without prior notice.
CANCELLATION OF MEMBERSHIP
19. The Proprietor may cancel the Membership of any Member: without notice and with immediate effect, without refund in the event of a Member committing serious or repeated non compliance of club rules or for any other reason at management’s entire discretion.
20. If any part of the Membership Subscription remains unpaid 30 days after the due date for payment, all monies owing to the Club in accordance with the contractual agreement will become due and payable immediately. If they are not paid, membership will be cancelled without prejudice to the right of the Proprietor to take whatsoever action it deems necessary to recover all monies due in accordance with the contract agreement.
21. Where the Proprietor cancels membership, the proprietor may refuse admission and access to other facilities and services.
22. Cancellation by Member: A Member paying his Membership subscriptions by monthly Direct Debit can cancel his membership at any time by giving one month’s written notice to Nexus Community. The Member is responsible for the cancellation of their direct debit arrangements with their bank. Membership subscriptions paid in full in advance are non-refundable.
USE OF FACILITIES
23. Membership does not include all of the Club’s services and facilities: services and facilities not so included may be provided at an additional charge at the Proprietor’s discretion.
24. Each member will receive his own individual Membership Card. This must be presented on each visit to the Centres and his individual Membership Number must be quoted for telephone bookings or enquiries. The Proprietor must be notified immediately in should a Member lose or damage his membership Card in order for a replacement to be provided.
25. Dependent upon each Leisure Centre’s rules for bookable activities: bookings not honoured will be charged at full rate; bookings cancelled with less than 24 hours notice that are not re-let will be charged at discounted rates. There will be no charge if the activity is re-let.
26. A Member must register with his membership card at reception before attending any activity. Failure to produce a receipt will result in entry being refused.
27. Where membership includes the benefits of the “Leisure Card”, the terms and conditions of the appropriate “Leisure Card Scheme” will apply. “The Leisure Card” terms and conditions are available to view at the individual centres and would have been supplied with your original membership card
28. It is a requirement of your membership that you provide a digital photograph of yourself which will be held securely on our database. This will be used purely as a way of validating your membership and confirming the identity of the card holder upon entry to and during use of the facilities. Failure to provide such a photograph, or to allow for a true likeness of yourself to be captured by the Company/Centre will deem your membership to be invalid and you may be refused membership benefits
HOURS OF OPENING
29. The Club’s normal hours of operation and the hours in which any facility within the Leisure Centres is available to Members is specified in the timetables and schedules of activities at each Centre. The Proprietor reserves the right to amend the opening hours according to business needs, with due notice. Current times and schedules will also be displayed at each Leisure Centre. The Member will be deemed to have notice of these arrangements.
30. In the event that the whole or part of the facility is closed due to inclement weather conditions or an incident outside the proprietors control no credit will be given on pre-paid memberships.
GENERAL
31. Fraudulent or wrongful information given in order to obtain a discounted membership will result in the cancellation of all membership rights and any action deemed necessary by the Proprietor.
32. In the event of any default by the Member, the Proprietor may disclose personal particulars contained in the Membership Agreement to a credit reference agency or any other party deemed necessary in obtaining settlement of arrears.
33. The Proprietor will make every effort to ensure that the full range of services as advertised is available but there may be circumstances beyond the control of the Proprietor where some services may not be available. In such circumstances the Proprietor will make no compensation or arrangements in lieu.
34. A copy of the Clubs and Leisure Centres rules are available to Members for inspection. All Members are deemed to have accepted these and all Members are required to comply with the same at all times.
35. The Proprietor retains the right to vary, add or eliminate any of the particular services or facilities provided within the scheme and the Centres from time to time.
36. The Proprietor may use the information provided by the Members to advise Members and Lapsed Members of The Proprietor’s other facilities and services. If a Member does not want The Proprietor to do this, he may instruct The Proprietor in writing accordingly.
37. Nexus Community have the right to amend the terms and conditions of membership as business needs dictate, which can include the addition of new facilities or membership options.
38. A free 7 day trial can only be requested by the same person once in a 12 month period, the management reserve the right to decline repeated requests made by the same person to trial the facilities.
